Part B — Indemnity, Assumption of Risk & Right of Admission
Please read this section carefully.
It explains responsibilities accepted by guests and visitors, limits that apply only to the extent permitted by law, and circumstances in which Villa Afriq may refuse admission or require a person to leave.
1. Reasonable Care and Personal Responsibility
Villa Afriq will take reasonable steps to maintain its premises and provide its services safely. Guests and visitors must take reasonable care of themselves, other people and property, follow reasonable safety instructions, and promptly report hazards, accidents, loss or damage.
2. Assumption of Ordinary Risks
To the fullest extent permitted by law, guests and visitors accept the ordinary risks reasonably associated with entering and using the premises and facilities. Each person remains responsible for loss, injury or damage caused by their own unlawful, intentional, reckless or negligent conduct.
3. Indemnity for Guest or Visitor Conduct
To the fullest extent permitted by law, a guest indemnifies Villa Afriq, its owner and staff against third-party claims, losses or reasonable costs arising directly from the unlawful, intentional, reckless or negligent conduct of that guest or a visitor invited or permitted by that guest, or from a material breach of these Guest Conditions.
4. Personal Belongings
Guests should secure money, identification documents, vehicles and other valuables and report suspected theft or loss promptly. Any limitation of Villa Afriq's liability for loss, theft or damage applies only to the extent permitted by applicable law.
5. Liability That Is Not Excluded
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from the gross negligence of Villa Afriq or a person acting for or controlled by Villa Afriq. Nothing in these terms removes any right or remedy available under the Consumer Protection Act or other applicable law.
6. Right of Admission and Removal
Villa Afriq may lawfully refuse admission or require a guest or visitor to leave where reasonably necessary to protect safety, security, property, privacy or quiet enjoyment, or because of unlawful conduct, threatening or seriously disruptive behaviour, dangerous intoxication, an unauthorised visitor or occupant, non-payment of an amount properly due, or a material breach of these Guest Conditions.
Any decision will be exercised reasonably, fairly and without unfair discrimination. Where circumstances allow, the person will be informed of the reason and given a reasonable opportunity to remedy the breach. A person who refuses to leave after a lawful instruction may be treated as remaining without permission and the matter may be referred to the appropriate authorities.
7. Charges, Refunds and Disputes
Removal from the premises does not automatically result in forfeiture of all amounts paid. Outstanding charges, refunds, damage claims and recovery costs will be dealt with under the applicable booking terms and law. Villa Afriq may recover only reasonable, substantiated amounts to which it is legally entitled. Legal costs may be recovered only where permitted by law and, where applicable, awarded by a court or agreed in a lawful written settlement.
